QR Hunter LLC — Terms of Use

Last Updated: October 12, 2026

1. Overview

Please read these Terms of Use (“Terms”) carefully. These Terms are an agreement between you and QR Hunter LLC (“QR Hunter,” “we,” “us,” or “our”) concerning your access to and use of https://www.qrhunter.com/, the QR Hunter mobile application, official QR Hunter QR code tiles, and related software, content, documentation, features, and services (collectively, the “Products and Services”).

QR Hunter provides tools for creating, sharing, and playing customized scavenger hunts. A person who creates or manages a hunt is an “Organizer.” A person who participates in a hunt is a “Player.” References to “you” include Organizers, Players, account holders, and other users, as applicable.

By accepting these Terms through an acceptance mechanism we provide, creating an account, or using the Products and Services after being presented with these Terms, you agree to be bound by them. If you do not agree, do not use the Products and Services.

THESE TERMS INCLUDE A BINDING INDIVIDUAL ARBITRATION AGREEMENT AND A CLASS ACTION AND JURY TRIAL WAIVER IN SECTION 23. PLEASE REVIEW THAT SECTION, INCLUDING ITS EXCEPTIONS AND YOUR RIGHT TO OPT OUT.

2. Privacy

Our Privacy Policy, available at https://www.qrhunter.com/policies/privacy-policy, explains how we collect, use, disclose, and retain personal information. Please review it before using the Products and Services.

Organizers must obtain any permissions required to submit information about other people or share it through a hunt. Do not include sensitive personal information, private access codes, or information about children in hunt content unless the applicable collection and disclosure are expressly permitted by our Privacy Policy and applicable law.

Nothing in these Terms replaces any separate consent required by applicable privacy or data protection law.

3. Eligibility and Acceptance

You must be at least eighteen (18) years old, or the age of legal majority where you live if higher, to create an Organizer account, make purchases, or enter into these Terms independently.

A minor may participate in an age-appropriate hunt only with the permission and appropriate supervision of a parent or legal guardian. An adult must manage the account and any device used by a child who is not eligible to use the Services independently. Children under thirteen (13) may not create accounts or submit personal information through the Products and Services. Adult supervision alone does not authorize the collection of children's personal information where additional legal requirements apply.

If you permit a minor to participate, you are responsible for supervising their participation and choosing suitable clues, locations, and activities. Nothing in these Terms purports to bind a minor where prohibited by law or waive rights that cannot lawfully be waived.

School & Educational Consent: If you are an Organizer representing an educational institution, school, or youth group, and you use the Products and Services with students or children under 13, you represent and warrant that you have obtained all necessary parental consents required under the Children's Online Privacy Protection Act (COPPA) and the Family Educational Rights and Privacy Act (FERPA) prior to such use.

If you use the Products and Services on behalf of a business, school, nonprofit, or other organization, you represent that you have authority to bind that organization. In that case, “you” includes both you and the organization.

You may not use the Products and Services if doing so would violate applicable law. You further represent that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

4. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms and update the date above. For material changes, we will provide reasonable advance notice through the website, application, email, or another appropriate method, unless a shorter notice period is required for legal or urgent security reasons.

Changes apply prospectively from the effective date specified in the notice. Where required, we will obtain your affirmative acceptance. Continued use after the effective date constitutes acceptance to the extent permitted by law. If you do not agree, stop using the Products and Services and cancel any applicable subscription.

Changes to the dispute resolution provisions will not apply retroactively to a dispute for which either party already provided notice.

5. Accounts and Security

Certain features require an account. You must provide accurate information and keep it current. You are responsible for protecting your login credentials and for activity you authorize through your account.

Do not share Organizer account credentials with Players. Use the hunt-sharing features provided by QR Hunter to invite participants.

Notify us promptly at help@qrhunter.com if you suspect unauthorized access or another security issue. We may require reasonable identity verification before processing account access, ownership, or recovery requests.

6. Equipment and Official QR Hunter Tiles

Using the Products and Services requires a compatible device, any necessary application or browser, a functioning camera where scanning is required, and an internet or mobile data connection. Hunts require official QR Hunter QR code tiles as described in our instructions.

You are responsible for your device, its security, permissions, and any internet or mobile carrier charges. Functionality may vary by device, operating system, connectivity, lighting, tile condition, and other circumstances.

Buying physical tiles does not guarantee that every digital feature will remain available indefinitely. Any specific access period or service commitment expressly stated at purchase remains applicable.

7. Analytics and Service Data

We may process account, device, diagnostic, usage, and gameplay information to provide, secure, maintain, troubleshoot, and improve the Products and Services, as described in our Privacy Policy and subject to applicable consent requirements.

These Terms do not independently authorize the sale of personal information, use of hunt content for AI training, or collection of precise location data. Any such practices require appropriate disclosures and any legally required consent or choice mechanisms.

8. Permitted Use and User Conduct

Use the Products and Services only for lawful, authorized purposes. You may not:

  • Create or distribute unlawful, threatening, abusive, discriminatory, sexually exploitative, or infringing content.

  • Harass participants, impersonate others, or collect or disclose information without authorization.

  • Create clues or activities that encourage trespassing, theft, property damage, dangerous conduct, or violations of law.

  • Use the Products and Services while driving or operating machinery.

  • Introduce malicious code, disrupt the Services, or access accounts or systems without authorization.

  • Use unauthorized automation to create accounts, scrape user information, or interfere with hunts.

  • Cheat, manipulate timers or results, circumvent access restrictions, or interfere with another participant's experience.

  • Copy or counterfeit official QR Hunter tiles, bypass code-validation mechanisms, or reproduce proprietary codes for unauthorized distribution.

  • Reverse engineer, decompile, or extract source code, except where applicable law expressly permits it.

  • Resell or sublicense access to the application or Services without written permission. Organizing a permitted hunt does not by itself constitute resale of the application.

9. Organizer Responsibilities and Hunt Safety

Organizers are responsible for the hunts they create, including clues, tile placement, locations, participant invitations, rules, supervision, and any prizes they offer.

Before sharing a hunt, an Organizer must:

  • Obtain permission to use locations and place tiles, including permission from property owners or venue operators where needed.

  • Choose locations and tasks appropriate for participants' ages, abilities, and circumstances.

  • Assess foreseeable hazards, including roads, water, heights, unstable terrain, weather, animals, restricted areas, and emergency access.

  • Avoid locations or activities that require trespassing, unsafe climbing, entry into hazardous spaces, or interference with emergency services.

  • Explain relevant boundaries, safety rules, and supervision arrangements to participants.

  • Remove tiles and other materials after the hunt when required by the property owner, venue rules, or law.

QR Hunter supplies tools for organizing hunts. We do not inspect, approve, supervise, or certify the safety of user-created hunts or locations. Providing a clue or displaying a code does not grant permission to enter a location or perform an activity.

10. Player Responsibilities, Gameplay Results, and Assumption of Risk

Players must pay attention to their surroundings, comply with applicable laws and property restrictions, and follow reasonable safety instructions. Stop participating if a clue, location, or activity appears unsafe. No timer, score, or competitive objective takes priority over safety.

Waiver of Liability and Assumption of Risk: Scavenger hunts involve physical activity, movement, and outdoor navigation. By participating, you voluntarily assume all risks of bodily injury, death, property damage, or disputes arising from your participation. You agree to release and hold harmless QR Hunter LLC from any and all liability, claims, or actions related to venue hazards, injuries sustained during a hunt, or the actions of other users or third parties.

Timers, progress indicators, completion records, and rankings, where available, may be affected by connectivity, device performance, interruptions, or technical errors. They are recreational features and are not guaranteed to provide certified or independently verified results.

Organizers are responsible for any prizes, contest rules, eligibility requirements, and compliance obligations associated with their hunts. QR Hunter does not sponsor or administer an Organizer's contest unless we expressly agree in writing.

11. User Content and Hunt Sharing

“User Content” means clues, hunt names, instructions, images, messages, and other material you submit through the Products and Services.

You retain ownership of your User Content. You represent that you have the rights and permissions needed to submit it and authorize its use as described in these Terms, and that it does not violate law or another person's rights.

You grant QR Hunter a nonexclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display, and technically adapt your User Content as necessary to operate, maintain, secure, and provide the Products and Services and the sharing features you choose. We may permit our service providers to exercise these rights on our behalf for those purposes.

This license ends when your content is deleted from our systems, except for limited retention permitted by our Privacy Policy or required by law, and copies already shared with other participants that we cannot reasonably retrieve.

A hunt link or start code may allow anyone who receives it to access associated hunt information. Share links and codes only with intended participants. Recipients may forward or copy them. Do not assume that information included in a shared hunt remains confidential.

We may review or remove content or restrict a hunt where reasonably necessary to enforce these Terms, respond to complaints, protect users, or comply with law. We do not undertake to review every hunt or item of content.

12. Changes to the Products and Services

We may add, modify, limit, suspend, or discontinue features for operational, security, legal, or business reasons. Where reasonably practicable, we will provide advance notice of changes that materially reduce a paid service during its prepaid term.

If we discontinue a paid service before the end of a prepaid term, or materially reduce it without providing a reasonable alternative, we will provide any refund required by law and, where appropriate, a prorated refund for the unused portion.

13. Software and Updates

Subject to these Terms and applicable app store rules, we grant you a limited, nonexclusive, nontransferable, revocable license to use the QR Hunter application on compatible devices you own or control for its intended purposes.

App Store Terms: If you access the Products and Services through an application downloaded from an app store (e.g., Apple App Store), you acknowledge that these Terms are between you and QR Hunter LLC, not the app store provider. The app store provider is not responsible for the application, its content, maintenance, support services, or any claims related to the application. The app store provider and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.

Updates may include security fixes, bug fixes, compatibility changes, and new features. Certain features may require the latest version. Updates may be delivered through your app store, device settings, or our systems, subject to applicable permissions and law.

14. Advertisements and Communications

The Products and Services may display promotional content where offered. We may send account, purchase, security, support, and service communications.

Marketing communications will be sent in accordance with applicable law and our Privacy Policy. You may unsubscribe from promotional emails using the provided unsubscribe mechanism. Unsubscribing does not prevent necessary transactional or service communications.

15. Purchases and Payment

You agree to pay the amounts disclosed when you purchase Products and Services, including applicable taxes and any disclosed shipping charges. You authorize the relevant payment processor to charge the payment method you select for the purchase you approve.

Keep payment information accurate and current. We may decline or cancel an order for a legitimate reason, including suspected fraud, unavailable inventory, or an obvious pricing error. If we cancel an order after payment, we will refund the canceled purchase.

Shipping estimates are estimates unless expressly guaranteed. Returns and refunds are governed by the policy disclosed at purchase and applicable law. These Terms do not limit mandatory consumer rights.

Purchases through an app store or other retailer may also be subject to that provider's billing, cancellation, and refund procedures.

16. Third-Party Services

The Products and Services may depend on third-party services, such as app stores, hosting providers, payment processors, and communications platforms. Your direct use of a third-party service is subject to its applicable terms and privacy policy.

We do not control third-party availability or performance. Nothing in this section limits our responsibilities for service providers acting on our behalf where applicable law imposes those responsibilities.

Use the designated QR Hunter scanning and sharing features. We do not guarantee the safety or authenticity of unrelated QR codes, third-party websites, or links placed by others.

17. Suspension, Termination, and Account Deletion

You may stop using the Products and Services at any time and request account deletion at help@qrhunter.com or through an available in-app deletion feature. Cancel any recurring subscription separately through the appropriate billing provider.

We may suspend or terminate access if you materially violate these Terms, misuse the Products and Services, fail to pay an applicable charge, create a safety or security risk, or where required by law. Where appropriate, we will provide notice and a reasonable opportunity to address the issue. Immediate action may be necessary for serious misconduct, urgent risks, or legal requirements.

Termination may make hunt content, links, progress, and other account information unavailable. Keep separate copies of content you wish to retain. Data deletion and retention are governed by our Privacy Policy and applicable law.

You remain responsible for charges properly incurred before termination. Refunds will be provided where required by law or expressly promised in these Terms or the applicable purchase terms.

18. Ownership and Trademarks

QR Hunter and its licensors retain all rights in the Products and Services, including the application, software, tile designs, proprietary codes, documentation, branding, and other intellectual property, except your User Content.

No rights are granted except those expressly stated in these Terms. You may not remove proprietary notices or use QR Hunter names, logos, or trademarks in a way that falsely suggests sponsorship, endorsement, or affiliation.

19. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DIGITAL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT, EXCEPT WHERE THOSE WARRANTIES CANNOT LAWFULLY BE DISCLAIMED.

We do not guarantee uninterrupted or error-free access, compatibility with every device, successful scanning in every circumstance, accurate timers or rankings, or preservation of all hunt data.

We do not guarantee that user-created clues, hunts, locations, or activities are safe, accurate, lawful, accessible, or suitable for a particular participant. QR Hunter is not an emergency response, navigation, or personal safety service.

Nothing in these Terms excludes an express product warranty we provide or any statutory warranty, remedy, or consumer protection that cannot lawfully be excluded.

20. Limitation of Liability and Indemnity

To the maximum extent permitted by law, QR Hunter and its officers, employees, licensors, and service providers will not be liable for indirect, incidental, special, consequential, or exemplary damages arising from these Terms or use of the Products and Services, including lost profits, lost data, or loss of goodwill.

To the maximum extent permitted by law, QR Hunter's aggregate liability arising from these Terms or the Products and Services will not exceed the greater of (a) the amount you paid QR Hunter for the Products and Services during the twelve months before the event giving rise to the claim or (b) one hundred dollars ($100).

These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence where applicable law prohibits such a limitation, or any other liability that cannot lawfully be excluded or limited.

To the extent permitted by law, you agree to indemnify and hold harmless QR Hunter and its officers, employees, and agents against third-party claims, damages, and reasonable costs arising from your unlawful User Content, your material violation of these Terms, or your violation of another person's rights, including in organizing a hunt. This obligation does not cover losses caused by QR Hunter's own negligence or misconduct.

We will provide reasonable notice of a claim for which we seek indemnification and an opportunity for you to participate in its defense. Neither party may agree to a settlement imposing an admission or nonmonetary obligation on the other without that party's consent.

21. Governing Law and Dispute Resolution

Governing law

These Terms are governed by California law, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs the arbitration agreement where applicable. Mandatory protections under the law of your place of residence remain available. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Informal resolution

Before starting arbitration, you and QR Hunter agree to attempt to resolve a dispute informally. Send a description of the dispute and the requested resolution to help@qrhunter.com. We will send any notice to you using the contact information associated with your account. Unless a shorter period is necessary to protect a legal right, allow thirty (30) days for informal resolution.

Individual arbitration

Except for the exceptions below and to the extent permitted by law, you and QR Hunter agree that disputes arising from these Terms or the Products and Services will be resolved through binding individual arbitration administered by JAMS under its applicable Streamlined Arbitration Rules and Procedures and, for consumer disputes, its Consumer Arbitration Minimum Standards, available at https://www.jamsadr.com/.

A single neutral arbitrator will decide the dispute. The parties will have a reasonable opportunity to participate in selecting the arbitrator, exchange relevant nonprivileged information, and present their claims. The arbitrator may award individual relief available under applicable law and will issue a written decision explaining the outcome. Judgment on the award may be entered in a court with jurisdiction.

For consumer disputes, fees, hearing arrangements, and location will comply with JAMS Consumer Arbitration Minimum Standards and applicable law. QR Hunter will pay arbitration costs that those standards or applicable law require it to pay. A hearing may occur remotely by agreement or in a reasonably accessible location. You will not be required to travel to Marin County, California, if doing so would impair your access to consumer arbitration.

Exceptions

Either party may bring an eligible individual claim in small claims court. Either party may seek temporary court relief necessary to preserve rights pending arbitration. Claims or remedies that applicable law does not permit to be subjected to arbitration or individual-only proceedings, including nonwaivable public injunctive relief where applicable, may proceed in a court with jurisdiction.

Class action and jury trial waiver

TO THE EXTENT PERMITTED BY LAW, YOU AND QR HUNTER AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS OR REPRESENTATIVE PROCEEDING. FOR CLAIMS SUBJECT TO ARBITRATION, YOU AND QR HUNTER WAIVE A JURY TRIAL.

If the individual-proceedings restriction is unenforceable for a particular claim or remedy, that claim or remedy will proceed in court, and the remainder of the arbitration agreement will apply to the extent permitted by law.

Opt-out

You may opt out of the arbitration agreement within thirty (30) days after first accepting these Terms by emailing help@qrhunter.com with the subject “Arbitration Opt-Out,” your name, the email address associated with your account, and a clear statement that you are opting out. Opting out will not affect your access to the Products and Services or the other provisions of these Terms.

For disputes that properly proceed in court, the parties consent to courts with jurisdiction in Marin County, California, except where applicable law gives you the right to bring a claim elsewhere.

22. Survival

Provisions that by their nature should survive termination will survive, including accrued payment obligations, intellectual property protections, applicable disclaimers and liability limitations, indemnity, and dispute resolution. Content licenses survive only to the extent stated in Section 11.

23. Severability

If a provision is invalid or unenforceable, it will be limited or severed to the extent necessary, and the remainder will remain in effect, subject to Section 21's specific rules for the arbitration agreement.

24. Entire Agreement

These Terms and any purchase or plan terms expressly incorporated into them constitute the entire agreement concerning their subject matter and replace prior agreements concerning that subject matter. Our Privacy Policy separately describes our personal information practices.

25. Waiver

A failure or delay to enforce a provision is not a waiver of the right to enforce it later. Any waiver must be express and in writing. Exercising one remedy does not exclude another available remedy unless applicable law or these Terms provide otherwise.
